1. Veri sorumlusunun kimliği

Veri sorumlusu, hublinkly.com adresinde yer alan Hublinkly platformunu işleten HUBLİNKLY AI YAZILIM VE TEKNOLOJİ LİMİTED ŞİRKETİ’dir.

2. İşlenen kişisel veriler

Platformun çalışması için gereken kişisel verileriniz aşağıdaki kategorilerde işlenmektedir.

Kanun’un 6. maddesinde sayılan özel nitelikli kişisel veriler (sağlık, inanç, biyometrik veri ve benzerleri) işlenmemektedir. Bu tür verileri profilinize veya mesajlarınıza yazmamanızı rica ederiz.

3. İşleme amaçları ve hukuki sebepleri

Kişisel verileriniz, Kanun’un 5. maddesinde öngörülen hukuki sebeplere dayanılarak ve aşağıdaki amaçlarla işlenmektedir.

Açık rızaya dayanan tek işleme faaliyeti analitik ölçümdür. Rızanızı vermemeniz ya da sonradan geri almanız hizmetin geri kalanını etkilemez.

4. Kişisel verilerin aktarılması

Kişisel verileriniz, Kanun’un 8. ve 9. maddelerinde öngörülen şartlara uygun olarak aşağıdaki alıcı gruplarına aktarılmaktadır:

• Diğer üyeler — yayımlanan şirket profiliniz rehberde görüntülenir; bir teklif talebi veya mesaj gönderdiğinizde bu, adınız ve şirketinizle birlikte karşı tarafa iletilir. Doğrulama belgeleriniz hiçbir üyeye gösterilmez.
• Hizmet sağlayıcılar (veri işleyenler) — bulut barındırma, veri tabanı ve dosya saklama, işlemsel e-posta gönderimi, ödeme ve web analitiği hizmeti aldığımız tedarikçiler. Bu tedarikçiler verileri yalnızca bize hizmet sunmak amacıyla, yazılı sözleşme ve gizlilik yükümlülüğü altında işler; kendi amaçları için kullanamaz. Güvenlik gerekçesiyle tedarikçileri ürün adlarıyla değil işlevleriyle belirtiyoruz; güncel listeyi talep üzerine paylaşıyoruz.
• Yetkili kamu kurum ve kuruluşları ile adli merciler — kanun, mahkeme kararı veya hukuka uygun resmî bir talep gereği.

YURT DIŞINA AKTARIM. Yukarıdaki hizmet sağlayıcıların bir bölümü yurt dışında yerleşiktir; bu nedenle kişisel verileriniz Kanun’un 9. maddesi kapsamında yurt dışına aktarılmaktadır. Aktarım, Kanun’un aradığı güvencelere — Kurul tarafından uygun görülen taahhütname, standart sözleşme veya yeterlilik bulunan ülke şartına — dayanılarak yapılır ve tedarikçi, veriyi yurt içindeki ile aynı düzeyde korumakla sözleşmesel olarak yükümlüdür.

5. Toplama yöntemi

Kişisel verileriniz; hublinkly.com üzerindeki kayıt, profil, doğrulama ve iletişim formları aracılığıyla doğrudan sizden, Google ile giriş yapmayı seçmeniz hâlinde ilgili sağlayıcıdan, platformu kullanmanız sırasında ise otomatik olarak (sunucu kayıtları ve çerezler yoluyla) elektronik ortamda toplanmaktadır.

6. Saklama süreleri

Süreler sona erdiğinde kişisel verileriniz silinir, yok edilir veya anonim hâle getirilir. Saklanması kanunen zorunlu olan kayıtlar yalnızca bu zorunluluk kapsamında ve o kapsamla sınırlı olarak saklanır.

7. İlgili kişinin hakları (KVKK m.11)

Kanun’un 11. maddesi uyarınca veri sorumlusuna başvurarak şu haklara sahipsiniz:

• kişisel verilerinizin işlenip işlenmediğini öğrenme;
• işlenmişse buna ilişkin bilgi talep etme;
• işlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme;
• yurt içinde veya yurt dışında verilerinizin aktarıldığı üçüncü kişileri bilme;
• eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme;
• Kanun’un 7. maddesinde öngörülen şartlar çerçevesinde silinmesini veya yok edilmesini isteme;
• düzeltme, silme ve yok etme işlemlerinin verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme;
• münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme;
• kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme.

8. Başvuru usulü

Yukarıdaki haklarınıza ilişkin taleplerinizi, Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ’e uygun olarak bize iletebilirsiniz.

En hızlı yol, sistemimizde kayıtlı e-posta adresinizden hello@hublinktech.com adresine yazmanızdır. Başvurunuzda adınızı ve soyadınızı, talebinizi açıkça ve kayıtlı e-posta adresinizi belirtmeniz gerekir. Başvurunuzu yazılı olarak şirketin kayıtlı adresine de gönderebilirsiniz.

Talebiniz, niteliğine göre en kısa sürede ve her hâlde başvurunun bize ulaşmasından itibaren otuz gün içinde ücretsiz olarak sonuçlandırılır. İşlemin ayrıca bir maliyet gerektirmesi hâlinde Kurul’ca belirlenen tarifedeki ücret alınabilir.

İşlem yapmadan önce kimliğinizi doğrulamanızı isteriz. Bu bir formalite değildir: kimlik kontrolü, verilerinizle sizin adınıza talepte bulunan bir başkası arasındaki tek engeldir.

Başvurunuzun reddedilmesi, verdiğimiz yanıtı yetersiz bulmanız veya süresinde yanıt verilmemesi hâlinde; yanıtı öğrendiğiniz tarihten itibaren otuz ve her hâlde başvuru tarihinden itibaren altmış gün içinde Kişisel Verileri Koruma Kurulu’na şikâyette bulunabilirsiniz.

9. Aydınlatma metnindeki değişiklikler

Bu metin güncellendiğinde sayfanın başındaki tarih değiştirilir. İşleme faaliyetini esaslı biçimde etkileyen bir değişiklikte, yürürlüğe girmeden önce kayıtlı üyelere e-posta ile bildirimde bulunulur.

2. Personal data processed

We process the following categories, and only what the platform needs in order to work.

Special categories of personal data under Article 6 of the Law — health, beliefs, biometric data and the like — are not processed. Please do not enter such data into your profile or your messages.

3. Purposes and legal grounds

Each purpose is tied to the ground in Article 5 of the Law that makes it lawful.

Analytics is the only processing that rests on explicit consent. Withholding it, or withdrawing it later, does not affect the rest of the service.

4. Transfers of personal data

Your personal data is transferred to the following groups of recipients, in accordance with Articles 8 and 9 of the Law:

• Other members — your published company profile is shown in the directory, and a request for quotation or message reaches the counterparty together with your name and company. Your verification documents are shown to no member.
• Service providers (data processors) — the suppliers from whom we obtain cloud hosting, database and file storage, transactional email, payment and web analytics services. They process the data solely to provide that service to us, under written contract and confidentiality obligations, and may not use it for their own purposes. For security reasons we identify them by function rather than by product name; we share the current list on request.
• Public authorities and judicial bodies — where a law, a court decision or a lawful official request requires it.

TRANSFERS ABROAD. Some of the service providers above are established outside Türkiye, so your personal data is transferred abroad within the scope of Article 9. Such transfers rest on the safeguards the Law requires — an undertaking approved by the Board, standard contractual clauses, or the adequacy condition — and the provider is bound by contract to protect the data to the same standard as if it had remained in Türkiye.

5. Method of collection

Your personal data is collected electronically: directly from you through the registration, profile, verification and contact forms on hublinkly.com; from the relevant provider if you choose to sign in with Google; and automatically while you use the platform, through server logs and cookies.

6. Retention periods

At the end of a period the data is deleted, destroyed or anonymised. Records we are legally required to keep are retained only to the extent of that requirement.

7. Rights of the data subject (Article 11)

Under Article 11 of the Law you may apply to the data controller and:

• learn whether your personal data is being processed;
• request information if it has been processed;
• learn the purpose of processing and whether the data is used in accordance with that purpose;
• know the third parties in Türkiye or abroad to whom it has been transferred;
• request that incomplete or incorrect data be corrected;
• request that it be erased or destroyed, within the conditions of Article 7;
• request that correction, erasure and destruction be notified to the third parties it was transferred to;
• object to a result reached against you by analysis carried out solely by automated systems;
• claim compensation if you suffer loss because the data was processed unlawfully.

8. How to apply

You may send us requests relating to these rights in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller.

The quickest route is to write to hello@hublinktech.com from the email address registered in our system. Your application must state your name and surname, your request clearly, and your registered email address. You may also apply in writing to the company’s registered address.

Your request is concluded free of charge as soon as possible and in any event within thirty days of reaching us. Where the process entails an additional cost, the fee in the tariff set by the Board may be charged.

We will ask you to confirm your identity before we act. This is not a formality: the identity check is the only thing standing between your data and someone who asks for it in your name.

If your application is refused, if you find our answer inadequate, or if we do not answer in time, you may complain to the Personal Data Protection Board within thirty days of learning our answer and in any event within sixty days of the date of your application.

9. Changes to this notice

When this notice is updated, the date at the top of the page changes. Where a change materially affects the processing, registered members are notified by email before it takes effect.
